Hermann Cohen (1842-1918) was among the most accomplished Jewish philosophers of modern times. This newly translated collection of his writings illuminates his achievements for student readers and rectifies lapses in his intellectual reception by prior generations.

In particular, the idea is that binding interactions between the relevant expressions and natural lan- guage quantifiers are best explained by the hypothesis that those expressions harbor hidden but bindable variables. Recently, however, Herman Cappelen and Ernie Lepore have rejected such binding arguments for the presence of hid- den variables on the grounds that they overgeneralize — that, if sound, such arguments would establish the presence of hidden variables in all sorts of ex- pressions where it is (...) implausible that they exist (Cappelen and Lepore (2005), Cappelen and Lepore (2002)).1 In what follows we respond to Cappelen’s and Lepore’s attempted reductio by bringing out crucial disanalogies between cases where the binding argument is successful and cases where it is not. But we have a deeper purpose than merely to respond to Cappelen and Lepore: we think the attempted reductio goes wrong by not taking sufficiently seriously the nature of the binding relation that holds between quantifiers and arguments/variables, and that our criticism will serve to highlight the nature and importance of this relation. The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

Can philosophy help ordinary people confront their personal or interpersonal problems of living? Can it help a couple whose marriage is on the rocks, or someone going through a midlife crisis, or someone depressed over the death of a significant other, or who suffers from anxiety about making a life change? These and many other behavioral and emotional problems are ordinarily referred to psychologists, psychiatrists, clinical social workers, or other mental health specialists. Less mainstream is the possibility of consulting a (...) philosophical counselor or practitioner. Yet, there is presently a steadily increasing, world-wide movement among individuals with postgraduate credentials in philosophy to harness their philosophical training and skills in helping others to address their life problems. But is this channeling of philosophy outside the classroom into the arena of life a good idea? Are philosophers, as such, competent to handle all or any of the myriad emotional and behavioral problems that arise in the context of life; or should these matters best be left to those trained in psychological counseling or psychotherapy? Through a diverse and contrasting set of readings authored by prominent philosophers, philosophical counselors, and psychologists, this volume carefully explores the nature of philosophical counseling or practice and its relationship to psychological counseling and psychotherapy. Digging deeply into this relational question, this volume aims to spark more rational reflection, and greater sensitivity and openness to the potential contributions of philosophical practice. CEO compensation has received much attention from both academics and regulators. However, academics have given scant attention to understanding judgments about CEO compensation by third parties such as investors. Our study contributes to the ethics literature on CEO compensation by examining whether judgments about CEO compensation are influenced by two aspects of a company’s tone at the top—social ties between the CEO and members of the Executive Compensation Committee and the CEO’s Reputation, particularly for financial reporting and disclosures. Although, stock (...) exchanges such as NASDAQ require ECC members to be independent, CEOs still may have social connections to the ECC. In addition, CEOs develop a reputation for the quality of their company’s financial reporting and disclosures. We expect both CEO Social Ties and CEO Reputation to impact say-on-pay judgments, and that fairness perceptions about the CEO compensation will mediate the relationship. We conduct an experiment to test our hypotheses. In this study, we employ a two by two experimental design where we manipulate CEO Social Ties with members of the ECC and CEO Reputation for the quality of financial reporting disclosures . Participants were MBA students who provided a say-on-pay judgment , and judgments about the fairness of the CEO’s compensation. Results indicate that CEO Social Ties affected participants’ say-on-pay judgments, which were fully mediated by their perceptions about fairness of the CEO’s compensation. Further, the CEO’s Reputation also affected participants’ say-on-pay judgments, which were fully mediated by their perceptions about fairness of the CEO’s compensation. In this essay I consider the question of whether Elliot D. Cohen has justified sufficiently the metaphysical basis for his Logic-Based Therapy as presented in his paper on “The Metaphysics of Logic-Based Therapy (IJPP, this issue). Although Cohen discusses four different foundations of his cognitive theory, I focus only on one. It is the most important basis of his theory, viz., that human beings logically deduce the cognitive-behavior com­ponents of their emotions from premises. First, I question Cohen’s (...) analysis of the emotion rules we use to deduce evaluations of actions from. Second, I challenge Cohen’s view that we deduce our evaluations from emotion rules. Although I do not think my challenges completely undermine Cohen’s theory, they do raise serious concerns for a theory faced with a preponderance of causal therapies. (shrink)

As G. A. Cohen’s camping trip argument shows, community is an important value. But is there anything particularly socialist about it? Critics suggest not. Jason Brennan argues that we don’t need socialist institutions to secure community; capitalist ones will do just fine. Louis-Philippe Hodgson argues, in a similar spirit, that we don’t need explicitly socialist principles to secure community; standard-issue liberal egalitarian ones (like Rawls’s) suffice. But these critics are mistaken. Pace Brennan, I show that capitalism inevitably runs roughshod (...) over community. Pace Hodgson, I show that Rawls’s justice as fairness cannot, absent explicitly socialist supplementation, adequately protect community. In sum, I show that advocates of community must also, and for that reason, be advocates for distinctively socialist principles and institutions. Or, in a slogan: no community without socialism. Don Isaac Abravanel was one of the first Jewish thinkers to express republican positions, yet very little is known about his knowledge of humanistic republican conceptions. Had he read Leonardo Bruni’s republican writings? Had he even heard of them? In this essay I attempt to address this philological gap by comparing Abravanel’s republican commentary on 1 Samuel 8 with Bruni’s Laudatio florentinae Urbis, especially the motif of the plea to God to authorize a political regime. This comparison is particularly (...) useful for illuminating their respective positions on republicanism, their shared interests and conceptions, as well as their divergent attitudes to their own political and historical environment. This divergence, I argue, sheds light on the early modern Christian and Jewish receptions of ancient republicanism. (shrink)

The question that is posed regarding the Jewish response to Hegel’s philosophy forces us to question the meaning of the adjective ‘Jewish’, and whether it points to some peculiar and distinct path and way of interpretation. I would say that in response to Hegel’s philosophy three distinguished thinkers, Samuel Hirsch, Hermann Cohen, and Franz Rosenzweig, responded to Hegel’s attitude toward religion and to the principles of his logic which underlie his concept of religion. Their response cannot be divorced (...) from their commitment to both an ethical and eschatological Judaism. Philosophical thinking shares religious and nonreligious categories and attitudes with theological and religious traditions, but does not employ these in similar ways. What is philosophical thinking is not necessarily theological. Although they do not necessarily relate to each other, they are not oblivious to the influence and force they have on one another. We would venture to say that in reference to Hirsch, Cohen and Rosenzweig, there was a distinct and clear attempt to confront the truth of Christianity with a truth that was believed to be superior. The first half of the nineteenth century gave us four significant Jewish thinkers who were eager and firm in their attempt to focus upon the differences in these two religions. In addition to Hirsch, they were Joseph Salvador, Salomon Formstecher, and Ludwig Steinheim. This paper, however, deals only with Hirsch and Cohen. (shrink)

This article examines G. A. Cohen’s endorsement of a hybrid ethical theory and its relationship to his critique of John Rawls’s egalitarian liberalism. Cohen claimed that Rawls’s appeal to special incentives was a distortion of his own difference principle. I argue that Cohen’s acceptance of a personal prerogative (the central element of Samuel Scheffler’s version of a hybrid ethical theory) has several untoward consequences. First, it illuminates how any reasonable challenge to Rawls’s liberalism must recognise Thomas (...) Nagel’s arguments concerning the problems that arise when one attempts to implement a political theory analogous to a hybrid theory of ethics. Second, it undermines Cohen’s critique of Rawls. Third, it undermines the plausibility of Cohen’s ethos-driven social egalitarianism. The article concludes that, despite Nagel’s concerns, the most plausible form of egalitarianism—one that can accommodate the requirements of a hybrid ethical theory—will be Rawlsian, rather than Cohen’s ethos-based system. Generics are sentences such as Birds fly, which express generalizations. They are prevalent in speech, and as far as is known, no human language lacks generics. Yet, it is very far from clear what they mean. After all, not all birds fly—penguins don’t! -/- There are two general views about the meaning of generics in the literature, and each view encompasses many specific theories. According to the inductivist view, a generic states that a sufficient number of individuals satisfy a certain (...) property—in the example above, it says that sufficiently many birds fly. This view faces the complicated problem of spelling out exactly how many is “sufficiently many” in a way that correctly captures the intuitive truth conditions of generics. -/- An alternative, the rules and regulations view, despairs from this project and proposes instead that generics directly express rules in the world. Rules are taken to be abstract objects, which are not related to the properties of specific individuals. This view faces the difficult problem of explaining how people come to know of such rules when judging the truth of falsity of generics, and accounting for the strong intuition that a sentence such as Birds fly talks about birds, not abstract objects. -/- What seems to be beyond dispute is that generics, even if they do not express rules, are lawlike: they state non-accidental generalizations. Many scholars have taken this fact to indicate that generics are parametric on possible worlds: they refer to worlds other than the actual world. This, again, raises the problem of how people come to know about what happens in these other worlds. However, a rigorous application of standard tests for intensionality shows that generics are not, in fact, parametric on possible worlds, but only on time. This unusual property may explain much of the mystery surrounding generics. -/- Another mysterious property of generics is that although there is no language without them, there is no linguistic construction that is devoted to the expression of genericity. Rather, generics can be expressed in a variety of ways, each of which can also express nongenerics. Yet, each manifestation of generics differs subtly (or sometimes not so subtly) in its meaning from the others. -/- Even when these and other puzzles of genericity are solved, one mystery would remain: Why are generics, which are so easy to produce and understand in conversation, so difficult to analyze? I provide an analysis of sentences of the form ‘To beFis to beG’ in terms of exact truth-maker semantics—an approach that identifies the meanings of sentences with the states of the world directly responsible for their truth-values. Roughly, I argue that these sentences hold just in case that which makes somethingFalso makes itG. This approach is hyperintensional and possesses desirable logical and modal features. In particular, these sentences are reflexive, transitive, and symmetric, and if they are true, then they are (...) necessarily true, and it is necessary that all and onlyFs areGs. I motivate my account over Correia and Skiles’ [11] prominent alternative and close by defining an irreflexive and asymmetric notion of analysis in terms of the symmetric and reflexive notion. Theoretical virtues play an important role in the acceptance and belief of theories in science and philosophy. Philosophers have well-developed views on which virtues ought and ought not to influence one’s acceptance and belief. But what do scientists think? This paper presents the results of a quantitative study with scientists from the natural and social sciences and compares their views to those held by philosophers. Some of the more surprising results are: all three groups have a preference order regarding theoretical (...) virtues, making theory choice a much more determinate matter than what has sometimes been suggested; the preference orders are very similar for the three groups; simplicity is viewed as an epistemic virtue particularly by social scientists ; and syntactic parsimony is preferred to ontological parsimony by all three groups. I draw upon Helen Steward's concept of agential settling to argue that freedom requires an ability to change the truth‐value of tenseless future contingents over time from false to true and that this ability requires a metaphysically open future.

In these writings by one of our most creative legal philosophers, Meir Dan-Cohen explores the nature of the self and its response to legal commands and mounts a challenge to some prevailing tenets of legal theory and the neighboring moral, political, and economic thought. The result is an insider's critique of liberalism that extends contemporary liberalism's Kantian strand, combining it with postmodernist ideas about the contingent and socially constructed self to build a thoroughly original perspective on some of the (...) most vital concerns of legal and moral theory.Dan-Cohen looks first at the ubiquity of legal coercion and considers its decisive impact on the nature of legal discourse and communication, on law's normative aspirations and claim to obedience, and on the ideal of the rule of law. He moves on to discuss basic values, stressing the preeminence of individual identity and human dignity over the more traditional liberal preoccupations with preference-based choice and experiential harm. Dan-Cohen then focuses more directly on the normative ramifications of the socially constructed self. Fundamental concepts such as responsibility and ownership are reinterpreted to take account of the constitutive role that social practices--particularly law and morality--play in the formation of the self.Throughout, Dan-Cohen draws on a uniquely productive mix of philosophical traditions and subjects, blending the methods of analytic philosophy with the concerns of Continental philosophers to reconceive the self and its relation to ethics and the law. Marxism has often been associated with two different legacies. The first rests on a strong exposition and critique of the logic of capitalism, grounded in a systematic analysis of the laws of motion of capitalism as a system. The second legacy refers to a strong historicist perspective grounded in a conception of social relations that emphasises the centrality of power and social conflict to the analysis of history. This article challenges the prominence of structural accounts of capitalism by showing how (...) the tension between these legacies has played out within Political Marxism, both orientations already having co-existed, somewhat uneasily, within Robert Brenner’s original contributions to the Transition Debate. Through this internal critique and re-formulation of Political Marxism, we wish to open a broader debate within Marxism on the need for a more agency-based account of capitalism, which builds more explicitly on the concept of social relations, to recover the historicist legacy of Marxism. The nonidentity problem is a deep puzzle challenging the moral intuition that what is bad must be bad for someone. The first part of the paper constructs a new theory of harming, whereas the second part builds on the conclusions of the first to offer a new solution to the NIP. The first part discusses the neglected question of when a burden inflicted in the context of overall benefitting can be discretized as a separate entity—only when it can, is it (...) possible to identify the burden as harm, and only then is it possible to harm in bringing into overall good existence. The second part explains how, in those cases where creating is indeed harming, we can use the logic of concept expansion to construct a concept of wronging that applies to creation cases. (shrink)
